Thomas Fitzgerald and Christopher M. Murray — on Sept. 22 denied to hear the appeal of James S. Altman, convicted in October 2005 of second-degree murder in the death of Christina J. Fisher. The ruling is the latest setback in attorneys Richard E. Priehs and Robert J. Dunn’s efforts to free Altman. A Michigan Court of Appeals — also featuring Talbot — upheld Altman’s conviction in 2007, the state Supreme Court did not consider the case and Midland County Circuit Judge Jonathan E. Lauderbach in June denied a motion to vacate the conviction.
